Modification of Terms and Conditions
The Copper Strawberry, LLC (Copper Strawberry) reserves the right to change these terms and conditions. You are responsible for regularly reviewing these terms and conditions. Before submitting your order, please read and review these terms and conditions. Copper Strawberry’s failure to insist on strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right.
Copper Strawberry is not in any way responsible for communications and materials posted by users accessing this site. As to any user generated content on this site, Copper Strawberry is merely acting as a passive conduit and is not undertaking any obligation or liability relating to such activities or activity on this site. However, Copper Strawberry reserves the right to block or remove any communications or materials that it determines to be (a) abusive, defamatory or obscene, (b) fraudulent, deceptive or misleading, (c) in violation of a copyright, trademark or other intellectual property right of another, (d) violates any law or regulation, or (e) is offensive or otherwise unacceptable to Copper Strawberry at its sole discretion.
Copper Strawberry does not warrant the merchandise purchased, however, some manufacturers do offer warranties on merchandise purchased from their company. Exclusion-this warranty does not cover (1) wear, fading, pilling, wrinkling, shrinkage, and dye lot variations of fabric or leather products; (b) damage due to negligence, misuse, fire, abuse, the elements or acts of nature, accidents, improper cleaning or discoloration from sunlight or artificial light sources; (c) variation of the color or graining of wood products, marble or leather; (d) finishes that have been affected by the purchaser; (e) merchandise sole “as is”; (e) breakage, chips, scratches of glass shelves, tabletops and glass products; (g)merchandise sold for commercial use. All warranties are limited to the original purchaser and delivery address only.
THERE ARE NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITTNESS FOR A PARTICULAR PURPOSE THAT APPLY TO THIS SALE. COPPER STRAWBERRY IS NOT LIABLE FOR DAMAGES OF ANY SORT INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES
Any claims or disputes by you against Copper Strawberry related to or arising under this agreement must be made in writing within seven (7) calendar days after your goods or services were delivered to you. You and Copper Strawberry agree to submit to the person and exclusive jurisdiction of the courts located in Clayton County, Iowa. You and Copper Strawberry agree that all claims and disputes shall be governed in all respects by the laws of the state of Iowa, U.S.A. without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree to try first in good faith to settle the dispute by mediation. All unresolved disputes shall then be decided by final and binding arbitration. Fees charged by mediators or arbitrators shall be shared equally by all parties. The prevailing party in any legal action brought under this agreement shall not be entitled to attorney fees and/or costs.
IN AGREEING TO ARBITRATION, YOU AND COPPER STRAWBERRY ACKNOWLEDGE THAT IN THE EVENT OF A DISPUTE OVER MERCHANDISE OR FEES CHARGED, EACH OF US IS GIVING UP THE RIGHT TO HAVE THE DISPUTE DECIDED IN A COURT OF LAW BEFORE A JUDGE OR JURY AND INSTEAD YOU AND COPPER STRAWBERRY ARE ACCEPTING THE USE OF ARBITRATION FOR RESOLUTION. YOU AND COPPER STRAWBERRY WILL PAY EQUALLY FOR THE ARBITRATION SERVICES.
Any award in arbitration hereunder shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount. Further, the arbitrator shall have no authority to award punitive, consequential or other damages not measured by the prevailing party’s actual damages in any arbitration initiated under this section, except as may be required by statute.
We strive to provide accurate product and pricing information, but pricing or typographical errors may occur. We cannot confirm the price of an item until after you order. If an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we have the right at our sole discretion, either to refuse or cancel any orders placed for that item. In the event the item is mispriced, we may, at our sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice. Prices do not include shipping or sale tax; sales tax and shipping will be charged on your order as applicable.
For special order Flamant items, we will visit with you personally about reserving your products for import. All products are packed and loaded carefully by Flamant in a dedicated ocean container and imported by Copper Strawberry for the most efficient and safest handling.
Import takes place when a Flamant container is filled by Copper Strawberry. Copper Strawberry can import to any port in the U.S.
Flamant wallpaper is distributed within the U.S. and can be imported with a lead time of two to three weeks if not in stock.
Flamant acrylic paint can be imported by special arrangement in an ocean container arriving during non-freezing months.
A 50% non-refundable deposit is required for special order. The deposit is refundable if the goods are undeliverable, as in out of stock, lost or damaged. The remaining 50% plus shipping/delivery charge is due when the item is shipped from Copper Strawberry to you.
For online sales, residents of Iowa are subject to Iowa state sales tax. All in store customers are subject to 7% sales tax.
Paying by credit card
Copper Strawberry accepts MasterCard, Visa, and Discover Network Credit and Non-PIN Debit transactions, as well as American Express Card.
Ordering online with Copper Strawberry is safe. Your payment and personal information is secured using Secure Sockets Layer
(SSL) encryption technology. Our credit data processing is fully compliant with the Payment Card Industry Data Security Standards (PCI DSS).
Ways of shipping
Small parcels: Copper Strawberry does not provide delivery. We offer delivery to you of all small items through an outside delivery company such as USPS, UPS or FedEX. Deliveries cannot be made to U.S. Post Office Box addresses.
Shipment to the 48 contiguous United States is by standard delivery in 2-4 business days. Rush delivery of 2 business days is available to these same states for an additional $15 fee if the order is received before noon Central Standard Time (CST). No overnight delivery at this time.
Standard delivery only and add $10 for delivery to Alaska, Hawaii, U.S. Territories, Armed Forces Americas and Canada.
Libeco Linen is shipped free in the contiguous United States.
Furniture: We ship furniture via van line service. Also known as white glove delivery, this involves two-person delivery inside your home, including placement and setup. It does not include assembly, if assembly is required. Smaller pieces such as chairs will ship either van line or freight, at the discretion of Copper Strawberry. Excellent handling of your piece is our priority.
Furniture will usually be delivered within one to two weeks, but can take up to four weeks for delivery, depending on delivery address. In all cases of white glove deliveries, Copper Strawberry will be in contact with you on an individual basis to personally verify your delivery date.
All shipping fees are flat rate, determined by size, overall cost and distance, and will nearly always be a savings to the customer over actual costs. For furniture, you may request the actual shipping quote to verify. Shipping fees for parcels and furniture will each be calculated separately and added at checkout for the best value to the customer.
International Shipping: Copper Strawberry has shipped to Canada, Australia and countries in Europe. Orders outside the U.S. must be made through direct contact with Copper Strawberry and not via online checkout.
Parcels - will be shipped through U.S. Postal Service or an international parcel service such as UPS or FedEx. The customer will be the importer of record and will bear all customs brokerage fees, import customs duties/taxes and freight forwarding fees.
Furniture - we can provide freight forwarding and assist with customs broker referral for furniture shipped from Copper Strawberry to Canada. The customer will be the importer of record and will bear all customs brokerage fees, import customs duties/taxes and freight forwarding fees.
For large dimension furniture to countries other than the U.S. and Canada, we can sometimes assist you with special arrangements.
At Copper Strawberry, your complete satisfaction is our goal, and most return requests are honored. If you must request a return, contact us immediately by email or phone for further instructions, and have your invoice or packing slip at hand. Return requests cannot be accepted after 30 (thirty) days.
You are responsible for all shipping costs on returns. All returns must be in original condition and packaging, otherwise additional charges may be applied.
Libeco Linens that have been unpackaged cannot be returned, so take care to approve of size and color before opening upon arrival.
Returned items that are damaged or lost during return transit are the responsibility of the customer. Therefore, please have the item insured for its full value for your own protection.
